BCX8\">\u00a0and make sure the Scheme\u00a0<\/span><span class=\"NormalTextRun SCXW45664734 BCX8\">remains<\/span><span class=\"NormalTextRun SCXW45664734 BCX8\">\u00a0available for future generations.\u00a0<\/span><\/span><span class=\"EOP Selected SCXW45664734 BCX8\" data-ccp-props=\"{}\">\u00a0<\/span><\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div data-contrast=\"auto\"> It may become harder for some people to access the NDIS<\/span><\/b><\/li><\/ol><p><span data-contrast=\"auto\">The Bill would introduce clearer tests for:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ul><li><span data-contrast=\"auto\">functional capacity (how a disability affects daily life)<\/span><\/li><li><span data-contrast=\"auto\">permanence of disability<\/span><\/li><li><span data-contrast=\"auto\">whether someone has tried allappropriate treatmentbefore being considered to have permanent disability<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li><\/ul><p><span data-contrast=\"auto\">People may also be directed to other systems, such as workers compensation, transport accident schemes, aged\u00a0care\u00a0or future foundational supports, before becoming eligible for the NDIS.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ol start=\"2\"><li><b><span data-contrast=\"auto\"> NDIS funding would be more tightly linked to approved disabilities<\/span><\/b><\/li><\/ol><p><span data-contrast=\"auto\">The Bill proposes that NDIS supports can only address needs that arise directly from the impairment that made someone eligible for the NDIS.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">For example, if someone has multiple health conditions, the NDIS may only fund supports linked to the condition that met the access requirements.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ol start=\"3\"><li><b><span data-contrast=\"auto\"> Plan reviews would be harder to request<\/span><\/b><\/li><\/ol><p><span data-contrast=\"auto\">NDIS participants may only be able to ask for a plan review outside their usual review time if there has been a significant and ongoing change in their:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ul><li><span data-contrast=\"auto\">disability support needs<\/span><\/li><li><span data-contrast=\"auto\">functional capacity<\/span><\/li><li><span data-contrast=\"auto\">living, work,educationor informal support arrangements<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li><\/ul><p><span data-contrast=\"auto\">The Government says this is intended to reduce unnecessary plan increases.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ol start=\"4\"><li><b><span data-contrast=\"auto\"> Unspent funds would no longer roll over<\/span><\/b><\/li><\/ol><p><span data-contrast=\"auto\">The current practice of extending plans and carrying forward unused funding would be replaced by annual plan renewals.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">People would keep their approved supports, but unused funds would not accumulate from one plan to the next.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ol start=\"5\"><li><b><span data-contrast=\"auto\"> The Government could reduce funding for some support categories<\/span><\/b><\/li><\/ol><p><span data-contrast=\"auto\">A significant proposed change is the creation of \u201csupport determinations\u201d,\u00a0which are rules that could allow funding in some support categories to be reduced across the Scheme.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">These would allow the Minister to reduce funding in certain support categories across the Scheme to help manage costs.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The Bill limits this power to:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ul><li><span data-contrast=\"auto\">assistancewith social, economic and community participation<\/span><\/li><li><span data-contrast=\"auto\">improved daily living skills<\/span><\/li><\/ul><p><span data-contrast=\"auto\">The Government has\u00a0stated\u00a0that supports related to\u00a024\/7 (SIL) supports,\u00a0employment and disability related health supports would be protected from these reductions.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fd87d27 data-contrast=\"auto\">The Bill would require decision makers to consider whether funding decisions are affordable and sustainable for the NDIS over time.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">This marks a shift from focusing solely on individual needs toward balancing individual supports with the\u00a0long term\u00a0sustainability of the Scheme.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ol start=\"7\"><li><b><span data-contrast=\"auto\"> Stronger compliance and fraud controls<\/span><\/b><\/li><\/ol><p><span data-contrast=\"auto\">The NDIA would receive broader powers to:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ul><li><span data-contrast=\"auto\">investigate fraud<\/span><\/li><li><span data-contrast=\"auto\">issue civil penalties<\/span><\/li><li><span data-contrast=\"auto\">require records to be retained<\/span><\/li><li><span data-contrast=\"auto\">audit participants,nomineesand providers<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li><\/ul><p><span data-contrast=\"auto\">Claims for supports would\u00a0generally need\u00a0to be\u00a0submitted\u00a0within 90 days instead of the current\u00a0timeframe\u00a0of two years.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6e15125 link elementor-widget elementor-widget-text-editor\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"auto\">The Bill is designed to keep the NDIS financially sustainable and reduce fraud, but it may also result in:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ul><li><span data-contrast=\"auto\">tighter access to the NDIS for some future applicants<\/span><\/li><li><span data-contrast=\"auto\">more scrutiny of support requests<\/span><\/li><li><span data-contrast=\"auto\">reduced funding growth in some support categories<\/span><\/li><li><span data-contrast=\"auto\">greater expectations that other service systems provide support where they have responsibility<\/span><\/li><\/ul><p><span data-contrast=\"auto\">For current participants, most changes would occur gradually over the next several years, with different measures\u00a0commencing\u00a0between late 2026 and 2028.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9650225 link elementor-widget
